Board Certification for Lawyers: What Does It Mean?*

Board certification recognizes attorneys’ special knowledge, skills and proficiency in various areas of law and professionalism and ethics in practice.  Established in 1982 by the Florida Supreme Court, board certification helps consumers identify specialists in various areas of law.
Certification is The Florida Bar’s highest level of evaluation of the competency and experience of attorneys in the 27 areas of law approved for certification by the Supreme Court of Florida.  Board certified lawyers are Evaluated for Professionalism, Tested for Expertise.
7 percent of eligible Florida Bar members, approximately 5,000 lawyers, are board certified. 
A lawyer who is a member in good standing of The Florida Bar and who meets the standards prescribed by the state's Supreme Court may become board certified in one or more of the 27 certification fields. Each area of certification may contain higher or additional standards.

Minimum Requirements for Certification

Practice law for a minimum of five years.
Demonstrate substantial involvement in the field of law identifying lawyers who have special skills and knowledge for which certification is sought.
Pass satisfactory peer review of competence in the specialty field as well as character, ethics and A lawyer who merely claims expertise in an professionalism in the practice of law.
Satisfy the certification area’s continuing legal education requirements.
Receive a passing grade on the examination required of all applicants or meet strict criteria to exempt the exam.

Not all qualified lawyers are certified, but those who are board certified have taken extra steps to have their competence and experience evaluated.

An Association attorney should help the Board to amicably resolve the many legal problems which an Association may face.  Because an Association's attorney can benefit financially from litigation, the attorney should be careful not to encourage litigation that might be avoided.  While an Association should always be willing to enforce its legal rights through litigation, the Association attorney should be working with the Board to negotiate fair settlements without unnecessary court action.  However, when disputes arise that cannot be resolved amicably, the Firm aggressively pursues its clients’ positions.

Our assessment collection department is professional and efficient. Each Association is assigned to one collection staff member who is the main contact for the Association. The Firm has successfully handled thousands of lien foreclosure and mortgage foreclosure cases for the Firm’s clients.

If you need discuss a matter in more detail, we can meet with the Board at our office or in your community.  We can also attend and help run membership meetings.

The Firm works with our clients to interpret governing documents, statutes, and case law in order to provide legal opinions to help guide our clients through the many legal and practical issues faced by community associations and country clubs.  We also work with our clients to review and amend Association governing documents as needed.  Whether it’s a simple change, or a complete restatement of the governing documents, we can help with the preparation and the process.

From cable contracts, to management contracts, to construction contracts, and more, we are able to prepare contracts for our clients, and also review vendor contracts and prepare necessary changes and addenda to ensure that our clients get what they need.
